CONCERNING
FOURTH AMENDMENT TO REGULATION OF THE MINISTER OF TRADE No. 12/M-DAG/PER/6/2005
CONCERNING PROVISION ON RATTAN EXPORT

BY GRACE OF THE ALMIGHTY GOD,
THE MINISTER OF TRADE OF THE REPUBLIC OF INDONESIA,

Considering:

• a. that in the context of smooth operation and effective implementation of rattan export and keep maintaining continuous supply of rattan as basic material for domestic industry, it is necessary to amend Regulation of the Minister of Trade No. 12/M-DAG/PER/6/2005 concerning Provision on Rattan Export as amended several times, and latest by Regulation of the Minister of Trade No. 28/M-DAG/PER/7/2008;
• b. that based on the consideration as intended in a, it is necessary to stipulate Regulation of the Minister of Trade;

In view of:

• 1. Trade Law 1934 (Statute Book No. 86/1938);
• 2. Law No. 10/1995 concerning Customs (Statute Book No. 75/1995, Supplement to Statute Book No. 3612) as amended by Law No. 17/2006 (Statute Book No. 93/2006, Supplement to Statute Book No. 4661);
• 3. Presidential Decision No. 260/1967 concerning Confirmation of Duty and Responsibility of the Minister of Trade in Overseas Trade sector;
• 4. Presidential Decision No. 187/M/2004 concerning Establishment of United Indonesia Cabinet that is amended several times, and the latest by Presidential Decision No. 171/M/2005;
• 5. Presidential Regulation No. 9/2005 concerning Position, Tasks, Functions, Organizational Structure, and Working Procedure of the State Ministry of the Republic of Indonesia as amended several times and the latest by Presidential Regulation No. 20/2008;
• 6. Presidential Regulation No. 10/2005 concerning Organizational Unit and Tasks of Echelon I of the State Ministry of the Republic of Indonesia as amended several times, and the latest by Presidential Regulation No. 50/2008;
• 7. Decree of the Minister of Industry and Trade No. 558/MPP/Kep/12/1998 concerning General Provision in Export as amended several times and the latest by Regulation of the Minister of Trade No. 01/M-DAG/PER/1/2007;
• 8. Regulation of the Minister of Trade No. 01/M-DAG/PER/3/2005 concerning Organization and Working Procedure of the Ministry of Trade as amended several times and the latest by Regulation of the Minister of Trade No. 24/M-DAG/PER/6/2009;
• 9. Regulation of the Minister of Trade No. 12/M-DAG/PER/6/2005 concerning Provision on Rattan Export as amended several times and the latest by Regulation of the Minister of Trade No. 28/M-DAG/PER/7/2008;

HAS DECIDED:

To stipulate:

REGULATION OF THE MINISTER OF TRADE CONCERNING FOURTH AMENDMENT TO REGULATION OF THE MINISTER OF TRADE No. 12/M-DAG/PER/6/2005 CONCERNING PROVISION ON RATTAN EXPORT

Article I

Several provisions in Regulation of the Minister of Trade No. 12/M-DAG/PER/6/2005 concerning Provision on Rattan Export is amended as follows:

1. Provision in Article 3 paragraph (3) has been amended so as to read as follows:

"Article 3

(1) Total volume of Original Rattan and Semi-Finished Rattan products exportable nationwide as intended in Article 2 paragraphs (1) and (3) must observe preservation of rattan growth and the need for basic material for domestic rattan industry.

(2) Total volume of Original Rattan and Semi-Finished Rattan products exportable as intended in Article 2 paragraphs (1) and (3) each year shall be decided by the Minister of Trade with due consideration of input from the relevant agency/institution.

(3) The total volume of Original Rattan and Semi-Finished Rattan products exportable for period July 1, 2009 until June 30, 2010 as set forth in the Attachment that is integral of this Ministerial Regulation."

2. Attachment to Regulation of the Minister of Trade No. 12/M-DAG/PER/6/2005 concerning Provision on Rattan Export as amended several times and the latest by Regulation of the Minister No. 28/M-DAG/PER/7/2008 has been amended by Attachment to this Ministerial Regulation.

Article II

This Regulation of the Minister takes effect on the date it is stipulated.

For public cognizance, this Regulation of the Minister shall be announced by placing it in the State Gazette of the Republic of Indonesia.
